The End User Licence Agreement for the Novellier software: what you may do with it, and what you may not.

1. Parties

This End User Licence Agreement (“EULA”) is between you and Leon Dean, a sole trader in the United Kingdom trading as Novellier (“the Licensor”). It covers the Novellier desktop app, the web editor, their updates and documentation (“the Software”). The Software is licensed, not sold. By installing or using it, you agree to this EULA.

2. Your licence

The Licensor gives you a personal, non-exclusive, non-transferable licence to:

  • install and use the Software on devices you own or control;
  • use it for personal or commercial writing; and
  • make a backup copy for recovery.

3. What you must not do

  • copy, sell, rent, sub-license or distribute the Software itself;
  • reverse engineer or decompile it, except where UK law allows this and it cannot be excluded;
  • bypass security, licence checks, credits, usage limits or feature controls, or exploit bugs to do so;
  • abuse our online services, for example with scripted or excessive requests;
  • share your account in a way that gets around licensing or billing.

4. Reporting security problems

If you find a bug or security weakness, please report it to novellierdev@gmail.com and give us a reasonable time to fix it before disclosing it publicly. Do not exploit it. Security researchers can also find our contact details at /.well-known/security.txt.

5. Ownership

The Software, the Novellier name and brand, and the design of the app belong to Leon Dean. You own the writing and other content you create with the Software; this EULA does not give the Licensor any ownership of it.

6. Online features and updates

Some features rely on online services and an account, and their availability can vary because of maintenance or third-party outages. The Software can update itself; you can turn automatic updates off in settings. Updates may change features, as described in our terms of service.

7. Privacy, payments and refunds

How we handle personal data is set out in our privacy policy. Paid plans, credits, cancellation and refunds are covered by our terms of service and refund policy.

8. Your rights and our liability

If you are a consumer, you have statutory rights, including under the Consumer Rights Act 2015, which this EULA does not reduce. The Licensor's responsibility for loss is set out in section 11 of the terms of service. If you use the Software for business purposes, the Licensor's total liability to you is limited to the amount you paid in the 12 months before the claim, and the Licensor is not liable for indirect loss, lost profits or lost data. Nothing limits liability that the law does not allow to be limited.

9. Ending this licence

You can end this EULA at any time by uninstalling the Software. The Licensor may end your licence if you seriously breach it, for example by circumventing licensing or billing. When it ends you must stop using the Software. The sections on ownership, liability and law continue to apply.

10. Law

This EULA is governed by the law of England and Wales, and its courts have jurisdiction, except where consumer law lets you bring a claim where you live in the UK.
